The Parental Rights Amendment

The proposed Parental Rights Amendment will specifically add parental rights in the text of the U.S. Constitution, protecting these rights for both current and future generations.
SECTION 1
The liberty of parents to direct the upbringing, education, and care of their children is a fundamental right.
SUMMARY: Parental Rights, currently recognized as implied rights, will become specifically enumerated in the text of the Constitution.

In the 1925 decision of Pierce v. Society of Sisters, the U.S. Supreme Court struck down a compulsory attendance act that required all parents to send their students to public schools, instead of private or religious schools. The court concluded that the act was unconstitutional because it "unreasonably interferes with the liberty of parents and guardians to direct the upbringing and education of children under their control."

In 2000, the Supreme Court cited a long train of previous cases which showed that the right of parents to direct the education and upbringing of their children is a fundamental right. The following passage, taken from Troxel v. Granville, highlights the rich history of this fundamental right:
In subsequent cases also, we have recognized the fundamental right of parents to make decisions concerning the care, custody, and control of their children. See, e.g., Stanley v. Illinois, 405 U.S. 645, 651, 92 S.Ct. 1208, 31 L.Ed.2d 551 (1972) ("It is plain that the interest of a parent in the companionship, care, custody, and management of his or her children 'come[s] to this Court with a momentum for respect lacking when appeal is made to liberties which derive merely from shifting economic arrangements'" (citation omitted)); Wisconsin v. Yoder, 406 U.S. 205, 232, 92 S.Ct. 1526, 32 L.Ed.2d 15 (1972) ("The history and culture of Western civilization reflect a strong tradition of parental concern for the nurture and upbringing of their children. This primary role of the parents in the upbringing of their children is now established beyond debate as an enduring American tradition"); Quilloin v. Walcott, 434 U.S. 246, 255, 98 S.Ct. 549, 54 L.Ed.2d 511 (1978) ("We have recognized on numerous occasions that the relationship between parent and child is constitutionally protected"); Parham v. J. R., 442 U.S. 584, 602, 99 S.Ct. 2493, 61 L.Ed.2d 101 (1979) ( "Our jurisprudence historically has reflected Western civilization concepts of the family as a unit with broad parental authority over minor children. Our cases have consistently followed that course"); Santosky v. Kramer, 455 U.S. 745, 753, 102 S.Ct. 1388, 71 L.Ed.2d 599 (1982) (discussing "[t]he fundamental liberty interest of natural parents in the care, custody, and management of their child"); Glucksberg, supra, at 720, 117 S.Ct. 2258 ("In a long line of cases, we have held that, in addition to the specific freedoms protected by the Bill of Rights, the 'liberty' specially protected by the Due Process Clause includes the righ ... to direct the education and upbringing of one's children" (citing Meyer and Pierce)). In light of this extensive precedent, it cannot now be doubted that the Due Process Clause of the Fourteenth Amendment protects the fundamental right of parents to make decisions concerning the care, custody, and control of their children. (emphasis added)

The parental right to direct education includes the right to choose, as an alternative to public education, private, religious, or home schools, and the right to make reasonable choices within public schools for one's child.

SUMMARY: Parents have a right to make reasonable choices for their child in public schools, such as opting their child out of classes the parents find objectionable. It does not give parents any power to dictate curriculum or other choices by the school for the student body at large.
In 2005 the Ninth Circuit Court of Appeals determined that a parent's fundamental right to direct their child's education ends at the threshold of the school door (Fields v. Palmdale,427 F3d 1197, 2005). This section will return to parents the right to make reasonable decisions for their child, even in the public schools. It does not include any right to make decisions for others' children or the school as a whole. However, it sets a low standard that parents need to reach to make decisions for their own student. To override this right, it would not be enough to show that, for instance, the request is not the best for the student or the school. The government would have to show that a parent's request was unreasonable.
The "reasonableness standard" is the lowest standard in constitutional law, and therefore the easiest test for parents to meet.

SUMMARY: While parental rights do not include a right to commit child abuse or neglect, they are due the same high legal protection as other fundamental rights.

Because fundamental rights are so important to our freedom as Americans, the government must meet a heightened burden of proof in order to restrict those rights. In legal terms, the government's case begins with a positive demonstration – they must prove that there is a government interest in restricting the right, and that the government has a specific interest in restricting the right of the particular parents whose actions are being challenged.
In early 2006, the U.S. Supreme Court used this very language when talking about violations of religious liberty. According to the Court, the government must "demonstrate that the compelling interest test is satisfied through application of the challenged law 'to the person'--the particular claimant whose sincere exercise of religion is being substantially burdened."Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal, 546 U.S. 418, 430-431 (2006). The text of this proposed parental rights amendment merely takes this well-established principle of law, and applies it explicitly to the fundamental right of parents.

In 1972, the U.S. Supreme Court held that in order for the state of Wisconsin to override the rights of Amish parents, the government had to show that it had a compelling interest in requiring students to stay in school until age 16. Speaking of the right of the parents, the Court said that "the essence of all that has been said and written on the subject is that only those interests of the highest order and those not otherwise served can overbalance legitimate claims to the free exercise of religion." Wisconsin v. Yoder, 406 U.S. 205, 215 (1972) (emphasis added).
The Supreme Court has required the government to follow this standard whenever there is a violation of a fundamental right. Prominent examples of this are cases that deal with racial discrimination (see Adarand v. Pena, 515 U.S. 200, 227 (1995): "All racial classifications, imposed by whatever federal, state, or local governmental actor, must be analyzed by a reviewing court under strict scrutiny. . . . Such classifications are constitutional only if they are narrowly tailored measures that further compelling governmental interests"), restrictions on free speech (see Widmar v. Vincent, 254 U.S. 263, 269-270 (1982): Whenever discriminating against speech on the basis of its content, the government "must show that its regulation is necessary to serve a compelling state interest and that it is narrowly drawn to achieve that end"), and invidious discrimination against religion (see Church of the Lukumi Babalu Aye, Inc., v. Hialeah, 508 U.S. 520, 546 (1993): "To satisfy the commands of the First Amendment, a law restrictive of religious practice must advance 'interests of the highest order' and must be narrowly tailored in pursuit of those interests." In all these cases, the government must prove that it has a compelling interest, before the fundamental freedom at stake can be limited.

SUMMARY: Discrimination against persons with disabilities or parents whose children have disabilities is prohibited.

This language follows the structure of existing constitutional prohibitions against denying the right to vote on the basis of race (Amendment 15), sex (Amendment 19), the paying of a poll tax (Amendment 24), and age (Amendment 26). It seeks to guarantee to persons with disabilities the same legal presumption of parental fitness that is extended to every other parent.

This article shall not be construed to apply to a parental action or decision that would end life.

Section Five stipulates that the Amendment will not apply to life-ending decisions. Current law will continue to control in that rare instance. This exclusion was a necessity to avoid the appearance that the PRA would affect the abortion issue either way, which would make its passage a political impossibility.

HELP ME FIND MY CHILDREN !!!

I live in Tampa FL currently and my kid's reside in Pinellas County FL. You may not be aware but recently we had Hurricane Irma threat to our area. Luckily it was not as bad as it was expected to be. The Pinellas County area was evacuated and my son's and their father left the State of Florida on September 10, 2017. Since that day I have not heard from them. I am 😞 worried.
I called the Pinellas County Sheriffs Office (PCSO) to conduct a well check to see if my children were safe. The deputy stated that it appears that everyone has evacuated the premises and that my husbands car was still in the parking lot. I asked the deputy if he could please write a report concerning my call and what he found. The deputy seemed very bothered by my request since he mentioned that he has many of these calls. I asked him kindly to do so that way I can bring a copy of his report to court on September 22, 2017 to provide proof of concern about the welfare of my children.
LAST TEXT MESSAGE FROM MY HUSBAND SEPTEMBER 10, 2017
The last time I heard from them was four day's ago and I got a text message that they were in Alabama. He was driving a minivan. It appears that his phone may be dead. It goes straight to voicemail and he is not responding to any of my text's. What am I supposed to do? I love my boys and I need to know if they are alive or dead.

GOD has designed special configurations among the stars to function as signs. They are signs that herald prophetic events among the Earth. Our fatal sin is the replacement of holiness with human rights as our guiding moral principle in life and government. This is a direct opposition to the Lords decree:

They manifest insanity of pornographic rights, abortion rights, and homosexual rights. This is why evil has become good and good has become evil in our land.
The unrepentant adherence to the doctrine of human rights that is producing the trampling of the holiness of God in our courts is the garuntee of the firestorm of the golden empire. Your only hope will be to turn to the Lord Jesus Christ. For Jesus himself said:

Are YOU going to make an impact?

That is the question... Even if you think none of this concerns you. It is YOUR human right to stand up in an assembly of humans and advocate for what you believe to be right. 10 years from now you may wish you had done just that. The moment is now. Carpe Diem! Cease the day.
You don't necessarily have to be a mom, dad, or grandparents to have this matter effect you. Who is to say that it hasn't already through divorce, adoption, or human trafficking? You may also be somebody's uncle or aunt someday. In your gut you know, intuitively you can feel, that what is being said and done as acceptable to our children is NOT RIGHT. So why aren't you doing anything to change that? There are many ways that you can.
1. First, you can read this blog and become aware of what has been happening across the nation's with the PCRM (Parental Civil Rights Movement) which has been on the uprise, and what it is about at: parentalrightsmovement.blogspot.com
2.You can reply to this message with your e-mail, and add your name to the petition. To add to the many people who want to be updated, informed, and contribute your own thoughts and ideas. Be a part of the change, and reformation within our civil family court laws & procedures, that should be implemented to protect the rights of all children, who are now being taken advantage of, and currently don't have a voice.
3. Raise awareness and pass it on.
The bird is the word. You have a voice right? Use it for our children that are vulnerable right now to this monstrosity that has become acceptable to humankind. It is NOT THEIR RIGHT! Spread this message with conviction. Our National Human Rights are being violated. You may not Trump Human Rights!
Just because our children are vulnerable and can't protect themselves, doesn't mean that parents shouldn't have the right to protect them either. How dare the law or state relinquish this right! Or try to estrange parents from their children! People, we need YOU to be outraged that this is even happening. How scary and threatened you must feel that humankind has succumbed so low to this level and YOU even allow it.
Have a heart before it becomes a burden that will one day haunt you, when you lose your grandchildren perhaps to human trafficking in the United States of America, which is being over run by your very own government. Really? Are you going to allow this?
4. Tell your State Representative that your NOT going to allow it any longer. You can easily write a letter.
I printed a list of all the State Reps across the USA in my last blog called The Million Parent March Soon. You can make a simple phone call or write. Be respectful but serious.
This is your chance to bitch, moan, and grown all you want. We are hoping that during the million parent march so many phone calls will start swarming in at that time, that the State Representatives will have no choice but to take care of the matter at hand, and push the law reform through so that change happens now.
So make your calls between September 16, 2016 and September 20, 2017. These four day's can change our future for our children. So please do your duty to your fellow human kind and make an impact. We really need everyone on board to see any fluctuating change.
5. Last but not least. Pack your bags, and book your tickets very soon for the Million Parent March at the white house in The District of Columbia in Washington D.C. on September 16, 2017- September 20, 2017. Be a part of the movement, that shall be a pivotol moment in our history, and will change the future for the next generations to come.
It is understandable that many of us cannot afford such an amazing feat. Those who can make it, your going to change history! That's friggin AWESOME!
You can still change history where right where you are at in your own home town. Very simple, wear all white those days to symbolize peace and prosperity amongst our people. You can't wear white everyday you say? That's fine just do it one day. You have four days to show you care about this cause.
Your support need only come from your 💙 heart. Stand on your street corner and voice your song, poem, writing, and opinion concerning our children. All they need is to see that you care. That's it! Your actions speak louder volumes than your words. Write them on poster boards and march them though the streets. Print your message on a T-shirt, buttons, and spray them on your vehicles. This may even be a chance to prosper. Prove to your children that you love them.
It really doesn't matter if you are not a US citizen, if your in another country, you are still human, and YOU ALSO HAVE A RIGHT TO STAND STRONG. SO DO THIS WITH US NATION'S AND SHOW THAT YOU CARE.
Be a part of it! Make an impact! It is an amazing cause. Raise awareness and your voice that we are the people that shall stand on behalf of our children and we won't accept what is happening any longer. THIS IS NO ONE ELSE'S RIGHT BUT MINE! Stop! Isolating the family infrastructure. Bring family value's back to the limelight. Let's stay positive and support one another. Help the fellow man.
Let our tax dollar's do what they are supposed to do and support the broken system like it should, and provide support, funding, housing, and respect to those in need. Stop taking advantage of poor, defenseless, innocent, and vulnerable children and start providing them with the stability they need.
Stop! Sugar coating it 3rd party organizations which are being run by the government. These organizations are currently corrupted, and not following their own morals and ethics, by estranging children from their mother's and father's. Live by your code and mission and really help support these people so they can fullfil their obligation to their children, and be reunified.
Enough Civil Family Law with all the discrimination, power struggles, control issues, false allegations, false persecutions, and long drawn out court proceedings. Love takes time and commitment and how can that be done when SHIT like this is tearing that apart? This is not within the best interest's of our children. You know it, I know it, and They know it.
You see this? This is all the hits and audience and awareness that has been generating since 2015.
Other nations are watching to see how we, as Americans, are going to handle this situation. This is happening Nationwide. You hear horror stories all over the world, and this is supposed to be America. We have a reputation to withhold. They do not call this the United States of America for nothing. This is supposed to be the land of freedom.
It is up to US as citizens of this country to stand strong by our morals as human kind alike in what we should believe to be right and just. If we don't, then we as the people shall have no right to complain when shit hits the fan.

Ok, we all said we were going to contribute. Here is your chance! It is time to make an impact and change the future for the zillion of upcoming generation's to come because God only knows how much time we are going to have left on this planet. So let's make them count. Right?
Who is coming with me? You don't have to RSVP just do it and be there. Scrounge up as much resources and energy you have left and feel like you are fulfilling your purpose for once in your life. I mean we are not getting any younger and who is to say you will ever get another opportunity like this again, or if we will even live to see tomorrow. I, B'onnie, will definitely be present with my megaphone, singing, and chanting from Capitol Hill all the way to the White House, and I cannot wait to meet all of the fabulous people who took the time off for their children and grand babies as to prove to all the world how very loved they are. There is nothing more important to us then our kids and we intend to prove it by standing strong in an assembly of people to protest that our Parental Civil Rights, must now, and FOREVER be enforced by the justice system.
If you don't have children yet, that is ok, all you have to do is believe in the cause to march and be present and speak your mind and help other's understand that Our National Human Rights are being violated right now. Our Children deserve Rights too for they are being VIOLATED, and this must STOP now. We can no longer tolerate our Human Rights being trampled on any longer. This needs to be erradicated and resolved now. We are standing UNITED and STRONG, PEOPLE will continue to do so until these changes are made and enforced.
During the march advocates will have petitions with particular laws that other parent's have found are not being implemented and enforced at this time. If you believe it is a law you stand by then please feel free to sign the petition, if it is a law that you do not agree with then don't bother. It will be as easy as that. You will not only be doing your children proud, but also your country just by being present and contributing to this civil rights movement. We shall, as an assembly of the people, be introducing these reforms to congress on the spot and shall not relent with ongoing phone calls and rallying till they are implemented eventually in the near future by Donald Trump. This usually only happens once a year. So PLEASE let's make it count.
Make a difference in our children's lives. Call your State Senators and schedule those appointment's after the march so lobbyist will be able to advocate for our children's rights. Forward all appointment's scheduled and information to Kyle Paskewitz kyle@fcru.org. Write to these State Senator's with your concerns and let them know we mean business. Follow through and spread the movement as well as the word that we mean business.
If your not able to make it to the Million Parent March you can still contribute around that time by blowing up (keep calling people you know what I mean don't get any crazy ideas) these senator's and congress legislators office phones. If we put a buzz in their ears that this matter is very serious and is not going to go away until there are immediate result's then we will just continue to do so because WE are not just one person anymore but millions all over the world. They may not see ALL of us outside their windows, but they will certainly HEAR ALL OF OUR VOICES across the nation's.
This issue is growing and becoming a monstrous crisis amongst all our nation's. Let us at least nip it in the bud and show all the other Nations how Americans do it so we can continue to live prosperous in the near future and be present to watch our children thrive and our grandchildren be happy 😂 .

If your not able to make it to the Million Parent March you can still contribute around that time by blowing up (keep calling people you know what I mean don't get any crazy ideas) these senator's and congress legislators office phones. If we put a buzz in their ears that this matter is very serious and is not going to go away until there are immediate result's then we will just continue to do so because WE are not just one person anymore but millions all over the world. They may not see ALL of us outside their windows, but they will certainly HEAR ALL OF OUR VOICES across the nation's.
This issue is growing and becoming a monstrous crisis amongst all our nation's. Let us at least nip it in the bud and show all the other Nations how Americans do it so we can continue to live prosperous in the near future and be present to watch our children thrive and our grandchildren be happy 😂 .
